Redistricting ruling has both sides looking at next steps

The decisions left the door open for future challenges to the practice. In a 2004 ruling, Justice Anthony Kennedy said that "extreme" partisan gerrymandering could be unconstitutional, but that the court would need a standard for deciding when a gerrymander crosses into "extreme" territory.

Commentators have treated the Court's decision in Whitford v. Gill, the Wisconsin gerrymandering case, as just a technical decision, a delay in getting a substantive decision out of the Court.
"We have evidence and findings of individual harm in every district", Smith said.
Justice Elena Kagan wrote a concurring opinion, joined by the court's other liberals, that provided a glimpse of what might have been.

That "packing" and "cracking" is what the Wisconsin residents said their GOP state legislature's majority did in 2011. More than a dozen states primarily use boards or commissions to redraw state legislative districts, and about a half-dozen do so for congressional districts.
