Supreme Court upholds Ohio method of removing names from voter rolls

A sharply divided US Supreme Court on Monday approved the practice by the state of OH of purging infrequent voters from their registration lists - a move civil rights groups claim disproportionately affects minorities and the poor.

The decision, which split the court along familiar ideological lines, comes amid a broader battle over laws about voter identification and registration. "The right to vote is not "use it or lose it"," Chris Carson, president of the League of Women Voters which has fought in favor of numerous voting rights cases, said in a statement. "This is a voter suppression campaign run out of the White House by President Trump, who has actively worked to undermine faith in American democracy".

Now, Sotomayor wrote, advocates for disadvantaged voters will need to "be even more proactive and vigilant in holding their States accountable and working to dismantle the obstacles they face in exercising the fundamental right to vote".

Earlier this year I was pondering whether Ohio's voter removal law was legal.

In the past, the Justice Department has opposed Ohio's process as inconsistent with federal law.

By contrast, under the Trump administration, the department switched sides.

Unlike many voting cases that come before the court, Monday's case centered not on grand constitutional principles but on interpreting seemingly contradictory directives of federal law.

OH does not run afoul of this prohibition because using non-voting to trigger the process is not the same thing as removing voters by reason of not voting. If a person skips voting in a single federal election, they will be sent a notice.

If there is no reply, and the voter stays away from the polls for four more years, they are purged from the system and would have to re-register to become eligible to vote again.

Justice Stephen Breyer, countered in his dissent: "In my view, Ohio's program does just that".

After voting in the 2008 presidential election, Harmon opted not to vote in 2009 or 2010.

But Alito said OH "takes an intermediate approach". It involves a politically charged topic - whether a state's effort to make it harder to vote should be permitted - as well as a not-especially-clear statute.

This case, like many others, should never even have been in court, allowing wayward judges and the ACLU to lock up a commonsense law for several years and election cycles.

OH takes a relatively aggressive approach to purging its rolls of voters, and the Supreme Court on Monday declared it's perfectly legal to do so.

For the five justices in the majority - Alito, along with Chief Justice John Roberts and Justices Anthony Kennedy, Clarence Thomas and Neil Gorsuch - the extent to which Ohio's practice hews to subsection (d) was enough. Although the state notifies the voter that they are in danger of being purged via a postcard, the entire process is triggered by the voter's failure to participate in the electoral process for "two consecutive years". He is joined by his four conservative colleagues.

After registered voters miss one federal general election, they receive a mailed notification acting to confirm their address. Others send the cards to registered voters at regular intervals. Studies, he said, showed that only about 4 percent of Americans moved outside their counties. And in a scathing separate dissent, Justice Sotomayor reminded the Court that it was perverting the entire goal of the motor-voter law by construing it as permissive toward voter purges - particularly those which, like Ohio's, disproportionately affects minority voters, which the same law prohibits.

"This decision is a validation of Ohio's efforts to clean up the voter rolls and now with the blessing of the nation's highest court, it can serve as a model for other states to use", Husted said. "I congratulate our attorneys throughout this case for their exceptional work in documenting how this process, used by Democrat and Republican secretaries of state, is indeed lawful".

Conservative advocacy groups praised the ruling.
