Trump Lawyers: A President Cannot Obstruct Justice

Giuliani's remarks follow reports that the president's legal team sent a letter to special counsel Robert Mueller in late January outlining a legal justification that as president, Trump can not be held accountable for obstruction of justice and should not be interviewed by investigators.

Trump has long said he wants to answer questions from special counsel Robert Mueller, but on Sunday Giuliani told ABC News, "It's beginning to get resolved" to not permitting the USA leader to sit for questioning.

"He has no intention of pardoning himself", Giuliani said on ABC Sunday.

"In no case can he be subpoenaed or indicted", Rudy Giuliani told HuffPost Sunday, claiming a president's constitutional powers are that broad.

In January of 2016, as the presidential campaign was moving toward the early primaries, Trump publicly claimed that he could "stand in the middle of Fifth Avenue and shoot somebody, and I wouldn't lose any voters".

More radically, according to the Times, the memo argues that because he has the power to stop the investigation, President Trump can not be accused of obstructing the investigation through his actions while it is ongoing.

"Pardoning other people is one thing, pardoning yourself is another". No president, for example, has ever tried to pardon himself.

It all stems from the investigation by special counsel Robert Mueller into alleged collusion between the Trump team and Russian officials in the election campaign that brought the president to power.

Meanwhile, Trump engaged in jabs at the Justice Department via Twitter on Sunday morning, going so far as to put "Justice" in quotes.

Mr Mueller is investigating whether Russian Federation meddled in the presidential election and whether Mr Trump's campaign colluded with Moscow.

Mueller's questions for Trump suggest that he is attempting to ascertain whether Trump obstructed justice by allegedly telling Comey that he "hoped" that Comey would let Flynn go. Part of the investigation includes whether Trump tried to obstruct justice in the federal probe of Russian efforts to interfere in the 2016 USA presidential election. He said that Trump wants to testify but that Giuliani and his team are leaning against recommending that. Todd asked him to clarify whether he was making the case "that [Trump] didn't obstruct or that a president can not obstruct justice".

This is not the first time the issue of the president's ability to pardon himself has come up. Giuliani added that a subpoena of Trump is "unnecessary" because Mueller's team has everything they need already.

In the letter penned by Trump lawyers John Dowd and Jay Sekulow, it was argued that President has the power to "order the termination of an investigation by the Justice Department or FBI at any time and for any reason". "I think the political ramifications of that would be tough".

"It could lead to impeachment, if he terminated an investigation of himself", Giuliani said in a separate interview on NBC's "Meet the Press". "Should have told me!"
