Former Saints cheerleader fired over racy Instagram post; files complaint

Jacalyn Bailey Davis filed a complaint with the Equal Employment Opportunity Commission that says the Saints and the National Football League hold female cheerleaders and male players to different standards of personal conduct.

The cheerleader was sacked in January just four days after sharing a photo of herself in a one-piece outfit to her private Instagram page. All this nonsense is part and parcel of an anti-fraternization policy that the Saints says is created to protect cheerleaders from the advances of players. That offense reportedly broke the Saints' strict ban on cheerleaders appearing nude or seminude.

The New York Times article details how sexist the franchise's duel rules for the cheerleaders are versus the male football player's rules.

The rules are so strict that the Cheerleaders can not give utter a word except greetings. They argue that players are not forbidden from trying to contact or fraternize with cheerleaders and that players' social media accounts are not restricted in the same way. She says the team has two sets of rules: one for the cheerleaders and and another for the players.

"Very poor judgment to post a picture like that especially considering our recent conversations about the rumors going around about u", Saintsations senior director Ashley Deaton texted Davis (pictured below on the right) four days before she was sacked, referencing a rumor that the cheerleader had attended the same party as a player.

Davis on Monday filed a complaint with the Equal Employment Opportunity Commission alleging the Saints have have drastically different sets of rules for its employees - one for men and one for women.

The New York Times reviewed the Saints' handbook for cheerleaders and found a policy that cheerleaders must avoid contact with players in person or on social media.

"The Saints did respond to Today with a statement, claiming it holds itself to a standard which states that "[we] do not tolerate discrimination of any kind, and it specifically denies that Ms. Davis was treated differently on account of her sex".

Before her termination, rumors swirled Davis attended a party with a group of players. Saintsations management told her she had a "dirty face" in the pictures, which invited attention from players, Davis said. "At the appropriate time and in the appropriate forum, the Saints will defend the organization's policies and workplace rules". The Times reports that cheerleaders are not allowed to dine in the same restaurant as players and must get up and leave if one walks in.

She said she hopes her case will help other cheerleaders by forcing the team to treat all its employees equally.

But on Sunday, the New York Times published an infuriating report that reveals that some teams exert nearly maniacal control over both the public image and personal lives of cheerleaders - all based on toxic, outdated notions of how both men and women should behave. The team accused her of breaking a rule and allegedly told her via text message that she should "know better". They're judged on how much fat hangs off their legs, forced into demeaning gigs, punished if their breasts "slouch", strictly monitored on how they carry on conversation, told how to wash themselves and lectured on etiquette, all while often receiving minuscule wages that don't always comply with labor law.

The Saints denied any discrimination took place. Cheerleaders from the Cincinnati Bengals and the New York Jets have also won settlements over poor pay. Eventually, she plans on filing a lawsuit against the team.

Davis' attorney, Sara Blackwell of The Blackwell Firm in Sarasota, says time's up on gender discrimination.

Davis said she is still a Saints fan.
