VW engineer sentence for role in emissions fraud

Liang's lawyer said the VW engineer is too old and slight to serve alongside risky felons in a low-security federal prison.

The sentence handed down Friday in Detroit was steeper than prosecutors requested for James Robert Liang (LANG).

A Volkswagen engineer who had a key role in the company's diesel emissions scandal has been sentenced to more than three years in prison and fined $200,000.

A USA court on Friday sentenced a former Volkswagen engineer to almost three and a half years in prison for his role in the company's emissions cheating scandal. Last month, former VW executive Oliver Schmidt struck a plea deal and could spend seven years in federal prison.

Liang was also ordered to serve two years of supervised release upon his release from prison, according to a spokesman for the U.S. District Court for the Eastern District of MI. A number of VW employees, current and former, have been charged with crimes connected to the scandal, though only one other is now in US custody.

Prosecutors in Germany are engaging in their own probe, though it is not clear if Liang could face additional penalties there.

The government says Liang wasn't the mastermind but took part in "pivotal events".

Judge Cox said Mr. Liang was an "important member of a long-term conspiracy involving Volkswagen engineers and senior management".

Judge Cox called the 10-year deception by VW "a stunning fraud on the American consumer", and a "very serious and troubling crime against our economic system".

Mr. Schmidt earlier this month pleaded guilty to charges of conspiracy and violating environmental law for concealing the use of illegal emissions software from USA and California regulators.

Mr. Liang, an engineer at Volkswagen since 1983, helped the auto maker install so-called defeat devices on diesel-powered vehicles after he and his colleagues realized the engines couldn't meet stringent USA emissions limits while maintaining the fuel economy and performance customers expected, prosecutors said in a legal memorandum filed before Friday's sentencing.

Liang also admitted that he helped his co-conspirators continue to deceive regulatory agencies and customers when evidence surfaced the vehicles' on-road emissions were more than 30 times higher than amounts shown in emissions tests, the release noted.

The automaker has admitted to programming its diesel cars to trick emissions testers into believing the engines released far less pollution into the air than they actually do, in violation of the federal Clean Air Act. Liang's lawyer had argued that instead of jail time, he could be sentenced to a period of house arrest, arguing that he was only following orders out of "misguided loyalty to his employer".
