In latest airline video, Delta boots family from flight

Delta Airlines staff misquoted rules and regulations governing overbooked flights as they removed a family with two children from one of its services, according to video that has been posted online.

An Orange County couple says they were kicked off a Los Angeles-bound Delta flight originating in Hawaii last month after airline staff insisted their 2-year-old son could not sit by himself, even though the family had paid for the seat.

Brian's wife said that it was terrifying that they were threatened by the airline despite being right. "As a mother, you have a 1-year-old and a 2-year-old - it doesn't matter whether that's true or false. It put fear in me", Brittany told KABC.

"Unbelievable. You guys are unbelievable", Schear says near the end of the video.

After much back-and-forth, Brian eventually agreed to hold his son on his lap for the flight.

The Schears ended up paying for another hotel room for the night, and a new flight on United for $2,000.

Schear said the airline told him that because his oldest son wasn't using the ticket, they needed to give the seat to another passenger.

"We never thought it was going to get to the point where they were actually getting us all off the flight", Schear told CBS2's Stacey Butler.

As the plane was about to take off, a Delta employee informed Schear that he would have to give up the extra seat because his 18-year-old was no longer using it.

In the video, recorded by Brittany, the family offers to hold the child during take-off before putting him back into the auto seat for the rest of the flight.

Brian told the Delta employee that his son flew out to Hawaii in a auto seat, and the employee called that "unfortunate".

The Delta website actually suggests in the "infant and child seating" section that parents traveling with children under two purchase a separate seat and use an approved auto seat for travel.

Brian and Brittany Schear, of Huntington Beach, Calif., were returning home after a vacation in Hawaii.

Another employee can be heard saying the child could not fly because the seat had been assigned to the family's teenage son, not the 2-year-old. The official also tells the man he will "go to jail" if he doesn't cooperate. "I'm not trying to cause a problem, but I believe in standing up for what's right". The encounter came as the airline industry is already facing bad publicity for video that showed a doctor being forcibly dragged off an overbooked Chicago flight on United, resulting in a concussion, broken nose, and two lost teeth.

Delta airlines said in a statement to AFP on Thursday that the company was "sorry for the unfortunate experience" and had reached out to the family to refund their travel and offer compensation. The Schear family told ABC7 the airline reached out to them after the incident to find out more about what happened.
